Fair enough your can't police everything and what happens behind closed doors stays there. I don't think it needs to be "Said" by the gamemasters, as it is shown;
These are private individual(s) providing a free service at entirely their own discretion, cost and effort.
They can choose at anytime to remove part of the service or remove the service entirely as it is provided solely at their discretion.
This shows that all rights to all but client files resident on a client computer are the property of the provider.
As for fraud, It's again like someone selling a friends borrowed car. You don't go after the owner of the car. You go after the friend that was paid for selling someone elses property. The rightful owner is faultless.

These responses don't assist any parties cause. It just antogonises other responses and as someone who is trying to help one of the parties it doesn't reflect well.
Please leave your discussions to emails between both parties and off of the forum. I welcome freedom of speech and everything. i am not trying to help any one i am just stating the facts as well as answering the question/issues some people have with them. i think if you look back i been talking about the issues of buying and selling characters in general that was brought up on the 1st page and i think you find in my last response that sums it all up.

I'll allow this thread to continue as it can only be used as an aid in the future.
Yes we'll need to spend more time looking into Ts & Cs. However, we thought being a free service and basically keeping a game alive we'd never have to seek legal advice (That's my weekend ruined). As for our stance on sharing accounts we've made it clear in the past. if you share an account you do so at your own risk. I'll do a db query later when the server isnt down from a DDOS attack and find references to this. Anyway keep the language clean and the responses educated. These sort of chats can only aid SomaDev publically and maybe the two parties will (hopefully) find a common ground without spending 6 months+ in small claims dispute.

You're not stating any facts though. My so called Mrs agrees it would have a place in court but small claims are not worth pursuing at a value of less than 5k due to the costs associated. You can later claim compensation but it's so unlikely to be awarded in civil cases its seldom done. Phoning CAB that one time doesn't make you Barrister Von Barriston.
As for them taking donations it's irrelevant. If they charged subscription then yes. But donations don't matter. Your opinion and the law differs.

I'm fully aware we have a grace period to provide any response and intend to use it to protect the server. As for the character the two parties can squabble it out.
