"RAVER""CARNAGE"Never thought I'd actually see the words soma and court in the same sentence. I mean I know this whole situation is no laughing matter but I can't even say soma and court in the same sentence without laughing.

Nobody has said they will/won't, but because people have mentioned it, someone can and probably will jump on the bandwagon at some point in the future just to ruin everyone else's fun because they've been foolish enough to buy an account and have then been given the shit end of the stick.

"ISYLVER"I'll allow this thread to continue as it can only be used as an aid in the future. small claims takes 14 day so i dont no were you get 6months+ from. "ISYLVER""YOSHIMITSU""ISYLVER"I'll allow this thread to continue as it can only be used as an aid in the future. 1st thing you should do is register you business and all so your t&c only cover the web site you need to cover the game but tbh its will still be a illgal game so doing any of this will not matter and am sure when you seek your own iegal advice they will tell you all this.

Yes we'll need to spend more time looking into Ts & Cs. However, we thought being a free service and basically keeping a game alive we'd never have to seek legal advice (That's my weekend ruined).
As for our stance on sharing accounts we've made it clear in the past. if you share an account you do so at your own risk. I'll do a db query later when the server isnt down from a DDOS attack and find references to this.
Anyway keep the language clean and the responses educated. These sort of chats can only aid SomaDev publically and maybe the two parties will (hopefully) find a common ground without spending 6 months+ in small claims dispute.
I know there are people who play Soma with legal experience/family/friends who will be more than willing to help out, just ask
I'd welcome all legal knowledge on this subject. Myself & Finito won't take this lightly and I'll be going to get legal advice when I get back from my holiday not this but next weekend. I'm fully aware we have a grace period to provide any response and intend to use it to protect the server.
As for the character the two parties can squabble it out.
its a free game.... not a business... a few donations for scrolls brings in very little£'s which i doubt cover the costs.
How can it be illegal? ''to do business, you must engage in some sort of transaction or exchange things of value'' Somadev not doing any of that.... no need for scare tactics..... 1 dickhead who lost out is causing the problems... If he had half a brain.. he wouldnt have tried to ''buy'' what isnt for sale

"ICEBLUE""ISYLVER"I'll allow this thread to continue as it can only be used as an aid in the future. We provide a service of hosting discontinued software with no aim for profit. We've tried to make conversation with mgame who absorbed comnjoy in the past regarding this to which they replied something along the lines of "what is soma?" and wanted nothing to do with it. As for small claims you wouldn't get anything sorted in 14 days. Parties have 14 days to send a first response then it goes on from there. I've been talking with the buying party regarding this matter on skype too and we're both aware it'd be a long drawn out process if it did happen due to the nature of the dispute and also the average duration of settlement. Also keep in mind that this dispute is between two parties that are not SomaDev. Yes our say may be needed for assistance in an action but not much more. At best your looking at a date being set after 30-60 days of filing. You then have to wait for this date then the verdict then wait for the debtor not to pay etc.

The small claims process takes months. Better ring your OAP at citizens advice again as you were misinformed. Considering all basic legal responses have a reply time of 14 days per correspondence.

"LUPISCUS"its a free game.... not a business... a few donations for scrolls brings in very little£'s which i doubt cover the costs. The source code for the original game was "copied" back in 2002? These copies form the basis for all private (pirate) servers for Soma, much like WOW private servers. Though I think Blizzard who is still in business has changed stance on pirate wow servers. "ISYLVER" Charging to play or setting up a business around the original source is an issue I believe.

Indeed and it will be. I was stating the long process of small claims and that you were incorrect in your 14 day assumption.

Isylv is basically telling us about the actions he's taking to try ensure proper ressumation of service to the players on his server. Which, he is perfectly entitled to do. Any court action would not involve the somadev team.
Lets face it.. a player that tries to buy something that isnt legally for sale isn't the brightest of guys. Then to whine and cry about it later, and cause hassle to the rest of the players, isnt a very nice guy. Instead of writing here attacking GM's , get ur whattasapp out or ur phone...and phone him up...and tell him to swallow his pride.. he's been a dikhead.. and stop fuk*in about. lesson 1 of business... u can'y buy what isnt for sale... pretty simple. And, if you pass over money for such items..... DOH
